1. Introduction

These Terms and Conditions apply to the sale of products by Bennett & Clarke to consumers via the website bennettandclarke.co.uk. Each order placed through the website forms a legally binding agreement between you and the company identified in section 2.

For the purposes of these Terms and Conditions, the following definitions apply:

Consumer — a natural person who is not acting in the course of their trade, business, craft or profession.

We / Us / Our — Bennett & Clarke, a brand operated by Peak Global Group, as identified in section 2.

You / Your — the consumer placing an order through our website.

Withdrawal period — the period during which you may exercise your right of withdrawal, as set out in section 6.

Day — a calendar day, including weekends and public holidays, unless we expressly state otherwise.

Distance contract — a contract that is concluded between us and you through our website, without simultaneous physical presence.

3. Applicability

These Terms and Conditions apply to every offer presented on our website and to every distance contract entered into between us and you.

The Terms and Conditions are made available to you before the contract is concluded, in a format that allows you to save them on a durable medium for later reference.

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Situations not expressly covered shall be interpreted in line with the spirit of these Terms and Conditions.

4. Products and Ordering

Each product on our website is presented with a description that we believe to be complete and accurate, so that you can make an informed purchasing decision. Photographs are intended to illustrate the item; minor variations in colour, finish or detail may occur as a result of screen settings, lighting conditions or production batches and are not considered defects.

Where an offer is valid for a limited period or subject to specific conditions, this will be clearly stated alongside the offer. We are not bound by obvious errors or typographical mistakes in an offer.

A contract between us and you comes into existence when you place an order through our website and we confirm receipt of that order by email. The confirmation will set out the contact route for complaints, your right of withdrawal, the warranty position, the total order amount and the payment methods accepted.

Within the limits permitted by law, we reserve the right to verify your creditworthiness or to refuse an order, and we may attach reasonable conditions to acceptance.

5. Prices and Payment

All prices shown on our website are stated in British Pounds (GBP) and are inclusive of any applicable taxes and duties. UK orders are dispatched on a Delivered Duty Paid (DDP) basis, which means that no further customs charges, import taxes or handling fees will be requested on delivery.

While an offer is valid, the price will not be increased unless an increase is required by law (for example, a change in tax rates). Any price change within three months after the contract has been concluded is permitted only where it is required by statutory rules.

Payment is taken at the point of placing the order. We currently accept Visa, Mastercard, Maestro, American Express, Apple Pay, Google Pay and Shop Pay. All transactions are processed by external payment providers and we do not retain your full payment-card details.

You are responsible for notifying us without delay of any irregularity in the payment data. Where payment is not received, we may suspend dispatch of the order and pass on reasonable collection costs.

By placing an order you accept a binding payment obligation. Initiating a chargeback without legitimate grounds does not release you from that obligation, and we reserve the right to take appropriate legal steps in such cases.

6. Right of Withdrawal

Your statutory right: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 calendar days from the day you (or someone nominated by you) take physical delivery of the goods, without having to give any reason.

Our extended voluntary return window: In addition to your statutory 14-day cancellation right, we offer a 30-day return period running from the day of delivery. This extended window is offered alongside, and does not replace, your statutory rights.

To exercise your right of withdrawal, please send a clear written statement of your decision to cancel to info@bennettandclarke.co.uk. You may use the Model Cancellation Form provided at the end of these Terms and Conditions, but its use is not mandatory.

During the withdrawal period, you should handle the product and its packaging with reasonable care. The product may be unpacked or used only to the extent necessary to assess its nature, characteristics and operation. Goods returned must be in their original condition: unworn, unwashed, undamaged, with all tags attached and, where possible, in the original packaging.

After notifying us, you must send the goods back without undue delay and we recommend you keep proof of postage (such as a tracking number).

Exceptions: The right of withdrawal does not apply to personalised or custom-made items, or to hygiene-sensitive items (for example, underwear) where the protective seal has been broken, unless those items are defective.

7. Returns and Refunds

Cost of return: Where you exercise your right of withdrawal, you bear the direct cost of returning the goods, except where the goods are defective, damaged or incorrectly delivered.

Return address: Because our orders ship directly from our fulfilment partner in China, returns also travel back to that location: Lecang, No. 168-230, Nijiayan Road, Yongjiang Street, Jiangbei District, Ningbo City, Zhejiang Province, China.

Please contact our customer-service team at info@bennettandclarke.co.uk before sending anything back, so we can confirm the return instructions and address details applicable to your specific order.

Refund timeline: Refunds are processed as soon as possible and in any event no later than 10 business days after we receive the returned goods or, where earlier, after you have provided proof of return shipment. Refunds are issued via the same payment method used for the original purchase, unless we agree another method with you.

Diminished value: Where the value of the goods has been reduced by handling beyond what was necessary to assess their nature, characteristics or operation, we may deduct that diminished value from the refund.

Faulty or misdescribed goods: Under the Consumer Rights Act 2015, the goods we sell must be of satisfactory quality, fit for their intended purpose, and as described in the listing. If your item does not meet these standards, you are entitled to a full refund, repair or replacement, in line with the following statutory framework:

  • Within 30 days of delivery, you have the short-term right to reject the goods and receive a full refund.
  • Within six months of delivery, we are required to repair or replace the goods; if this is not possible, you are entitled to a full refund.
  • After six months, you must give us the opportunity to repair or replace the goods before claiming a refund.

These statutory remedies are in addition to, and are not affected by, our 30-day voluntary return policy.

Exchanges: We do not run a direct exchange service. To swap an item for another, please return the original following the standard return procedure and place a new order on the website.

8. Delivery and Shipping

We exercise reasonable care in the fulfilment of every order. The delivery address you provide at checkout is binding. Risk of loss or damage to the goods passes to you only upon delivery.

Order processing: Orders placed before 6:00 PM GMT (Monday to Friday) are processed within 2–3 business days.

Delivery time: Once dispatched, transit takes approximately 4–9 business days. The total time from placing an order to receiving the parcel is therefore approximately 6–12 business days, including processing.

Shipping method: We provide free standard shipping to all addresses within the United Kingdom. There is no minimum spend. All orders ship Delivered Duty Paid (DDP), so any customs duty, import tax or VAT is already included in the checkout price. You will not be asked to pay any additional charge upon delivery.

Product origin: Our products are packed and dispatched directly from our fulfilment centre in Ningbo, China. The 6–12 business-day estimate already accounts for this international shipping route.

Order tracking: Once your order is dispatched, you will receive an email containing a tracking link so that you can follow the progress of your delivery.

Cancelling before dispatch: As a courtesy, you may cancel your order within 24 hours of placing it by contacting our customer-service team. If the order has already been dispatched, the standard return procedure applies. This courtesy does not affect your 14-day statutory right of withdrawal described in section 6.

Delivery times are estimates only. External factors such as customs inspections, severe weather or carrier delays can extend transit beyond our control, and we cannot accept liability for delays caused by such factors.

9. Product Descriptions and Accuracy

We make every reasonable effort to ensure that product descriptions and images on the website are accurate. Even so, minor differences in colour, texture or detail can occur due to monitor calibration, lighting conditions or variations between production batches.

Such minor variations do not amount to a defect and are not, on their own, grounds for return under either the statutory or voluntary return route, unless the goods received are materially different from the description.

10. Intellectual Property

All content available on bennettandclarke.co.uk — including but not limited to text, photography, illustrations, logos, product imagery and the design of the website itself — is owned by Bennett & Clarke (Peak Global Group) or its content partners and is protected by applicable intellectual-property laws. You may not copy, distribute, republish or otherwise commercially exploit any of this content without our prior written consent.

11. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above, our total liability to you for any claim arising out of or in connection with a contract concluded under these Terms and Conditions is limited to the total amount you paid for the order to which the claim relates.

We are not liable for any indirect, incidental, special or consequential losses arising in connection with your use of the website or the products you purchase from us.

12. Privacy and Data Protection

We process personal data in accordance with the United Kingdom General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use and protect your personal data are set out in our Privacy Policy.

13. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms and Conditions where the failure or delay is caused by circumstances beyond our reasonable control. These include, but are not limited to, natural disasters, public-health emergencies, war or armed conflict, terrorism, strikes, governmental decisions, failures of third-party suppliers or carriers, and disruptions to communications, energy or transport networks.

14. Complaints Procedure

If you have a complaint about your order or any aspect of our service, please contact us at info@bennettandclarke.co.uk with a clear, complete description of the issue. We will acknowledge your complaint within 2 business days and will aim to provide a substantive response within 14 days.

If our response does not resolve the matter to your satisfaction, you can obtain free, independent guidance on your consumer rights from Citizens Advice at www.citizensadvice.org.uk.

15. Amendments to Terms

We may amend these Terms and Conditions from time to time. The most recent version will always be published on this page, with an updated "Last updated" date at the top. Changes will not apply retrospectively to orders that have already been placed.

16. Severability

If any provision of these Terms and Conditions is found by a competent court to be invalid, illegal or unenforceable, that provision shall be treated as modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be treated as removed. The validity and enforceability of the remaining provisions shall not be affected.

17. Governing Law

These Terms and Conditions, and any contract concluded under them, are governed by and shall be construed in accordance with the laws of England and Wales.

Nothing in these Terms and Conditions limits or removes your statutory rights as a consumer under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

18. Dispute Resolution

Any disputes arising out of or in connection with these Terms and Conditions are, to the extent permitted by law, subject to the exclusive jurisdiction of the courts of England and Wales.

20. Consumer Rights Summary

As a consumer in the United Kingdom you have statutory rights that cannot be excluded or limited by these Terms and Conditions:

Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — you have the right to cancel a distance contract within 14 days of receiving the goods, without giving any reason. This statutory right exists alongside our 30-day voluntary return window.

Consumer Rights Act 2015 — goods must be of satisfactory quality, fit for purpose and as described. If goods are faulty, you are entitled to a refund, repair or replacement, depending on how long you have had the item.
